Valley Broadband Service Agreement
1. Introduction
Welcome to Valley Broadband! This Service Agreement ("Agreement") outlines the terms and conditions between Valley Broadband ("Provider," "we," "us," or "our") and the customer ("Customer," "you," or "your") regarding the provision of wireless internet services ("Services"). By signing this Agreement, you agree to the terms and conditions set forth herein.
2. Service Plans
Valley Broadband offers various internet service plans, each with specific speed, data, and pricing details. The plan selected by the Customer is as follows:

3. Service Provision
Installation: Valley Broadband will install the necessary equipment at the Service Address to provide the Services. The installation fee covers the initial setup. Any additional equipment or special installation requirements may incur additional charges, which will be communicated to the Customer before installation.
Equipment Ownership: All equipment provided by Valley Broadband remains the property of Valley Broadband unless explicitly purchased by the Customer. The Customer is responsible for maintaining the equipment in good condition and returning it upon termination of service.
Service Availability: Valley Broadband will make reasonable efforts to provide uninterrupted Services. However, due to the nature of wireless internet services, the Customer acknowledges that service interruptions or slowdowns may occur due to factors beyond our control, such as weather conditions, technical limitations, or equipment failures.
4. Payment Terms
Billing Cycle: The Customer will be billed on a monthly basis, with payment due on the [Due Date] of each month. The first bill may include a pro-rated charge for the partial month of service.
Payment Methods: Payments can be made via credit card. Late payments may result in a late fee of $5 per day.
Non-Payment: If payment is not received by the due date, Valley Broadband reserves the right to suspend or terminate Services. Service will be reinstated only upon full payment of the outstanding balance and any applicable reconnection fees.
5. Termination and Cancellation
Customer-Initiated Termination: The Customer may terminate the Services at any time by providing 30 days written notice to Valley Broadband. Any equipment provided by Valley Broadband must be returned within 30 days of termination. Failure to return equipment will result in additional charges.
Provider-Initiated Termination: Valley Broadband reserves the right to terminate this Agreement for non-payment, breach of terms, or any other reason with 30 days written notice to the Customer.
Early Termination Fee: If the Customer terminates the Agreement before the end of a contract commitment, an early termination fee of remaining contract value may apply.
6. Service Level Agreement (SLA)
Valley Broadband aims to provide 99.9% uptime for our Services. In the event of a service outage exceeding 4 hours in a billing cycle, the Customer may request a credit for the impacted period. This SLA does not apply to outages caused by events outside Valley Broadband’s control.
7. Customer Responsibilities
Acceptable Use: The Customer agrees to use the Services in compliance with all applicable laws and Valley Broadband’s Acceptable Use Policy (AUP), which can be found at getvalleybroadband.com. Misuse of Services, including but not limited to illegal activities, spamming, or excessive bandwidth usage, may result in suspension or termination of Services.
Security: The Customer is responsible for securing their network and devices against unauthorized access. Valley Broadband is not liable for any security breaches or data loss resulting from the Customer’s failure to secure their network.
8. Limitation of Liability
Valley Broadband’s liability to the Customer for any claim arising out of or related to this Agreement is limited to the total amount paid by the Customer for the Services in the previous months preceding the claim. Valley Broadband is not liable for any indirect, incidental, or consequential damages.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising out of or related to this Agreement shall be resolved in the courts of Kern County, California.
10. Amendments
Valley Broadband reserves the right to amend this Agreement at any time. Any changes will be communicated to the Customer via email or postal mail at least 30 days before the changes take effect. Continued use of the Services after the effective date of the amendment constitutes acceptance of the revised terms.
11. Entire Agreement
This Agreement constitutes the entire agreement between Valley Broadband and the Customer regarding the provision of Services. Any prior agreements, representations, or understandings are superseded by this Agreement.
